Sentencia Judicial HISTÓRICA en USA: la FDA debe clasificar la amalgama dental como material peligroso

MERCURIADOS recibió la IMPORTANTE INFORMACIÓN que sigue:  

Después de 10 años de 'batalla legal', el lunes 2.6.08, se ha producido una SENTENCIA HISTÓRICA en Estados Unidos, por la cual la FDA (digamos que el Ministerio de Sanidad y Consumo/Alimentación de USA) debe clasificar las obturaciones dentales de amalgama como un material potencialmente peligroso y ha tenido que cambiar el contenido de su página web, en la que, al menos, ahora ya se dice (www.fda.gov/cdrh/consumer/amalgams.html):

"Dental amalgams contain mercury, which may have neurotoxic effects on the nervous systems of developing children and fetus."

(Los empastes dentales de amalgama contienen mercurio, lo cual puede tener efectos neurotóxicos en los sistemas nerviosos de niños y fetos)

"Pregnant women and persons who may have a health condition that makes them more sensitive to mercury exposure, including individuals with existing high levels of mercury bioburden, should not avoid seeking dental care, but should discuss options with their health practitioner."

(Las embarazadas y las personas que puedan tener características que las puedan hacer más sensibles a la exposición al mercurio, lo que incluye personas con elevados niveles de carga biológica mercurial, no deben evitar buscar atención bucodental, sino que deben discutir alternativas con su profesional de la salud)

Nuestro COMENTARIO/REFLEXIÓN:  

Sin duda, es un paso MUY importante, pues, indirectamente, supone un "toque de atención" y una "bajada de humos" para la ADA (Asociación Dental Americana) y todas aquellas asociaciones dentales de dentro y fuera de Estados Unidos, así como para aquellos colegios profesionales de odontólogos/estomatólogos que aún siguen empecinados en defender "a capa y espada" (por algo será: www.elconfidencial.com/cache/2008/06/04/58_podemos_confiar_nuestros_medicos.html) una supuesta seguridad de los empastes dentales de amalgama, sin ruborizarse siquiera, cuando, lo lógico, en aras de la defensa de la seguridad de sus pacientes, sería aplicar el "Principio de Precaución". PERO, lo lamentable de todo este singular asunto (históricamente, también se había dado el Visto Bueno a la amalgama dental sin que JAMÁS se demostrase su seguridad) es que tenga que ser la Justicia la que, al fin y a la postre, tenga que dirimir un problema EVITABLE.  Ya es hora de que las asociaciones dentales y los colegios profesionales de odontólogos/estomatólogos reaccionen adecuadamente y enmienden un ERROR HISTÓRICO (errar es humano, pero rectificar es de sabios). Dicha rectificación debería hacerse, al menos, en base a la prevención. [Ver “10 RAZONES ANTI-AMALGAMA“: www.mercuriados.org/es/pag249]. Eso sí, no menos responsabilidad tienen, en todo esto, los Ministerios/Consejerías de Sanidad de cada país. De hecho, en España ya está en marcha la Demanda Judicial contra el Ministerio de Sanidad español, por el uso inadecuado e inadvertido del llamémosle ‘mercurio sanitario’ (ver: www.mercuriados.org/es/pag191), por ni siquiera INFORMAR a la población en general (y a los profesionales sanitarios, en particular) del riesgo, para la salud y el medio ambiente, que SÍ supone el mercurio presente en los empastes dentales de amalgama (en base a informes OFICIALES de la Organización Mundial de la Salud, de 1991, 2003 y 2005, etc.: www.mercuriados.org/es/pag117). El derecho a la información y a la salud, son dos derechos básicos e inalienables.  Asimismo, se están preparando varias Demandas Judiciales, a nivel autonómico, contra Consejerías de Sanidad, por Desatención Sanitaria (errores continuados de diagnóstico, no buscar y sugerir aplicar tratamientos adecuados para los afectados por mercurio, etc.). LO “GRACIOSO” es que todo esto era EVITABLE (simplemente, no poniendo/manipulando empastes dentales de amalgama) y redundaría positivamente en la salud de los pacientes y en las siempre mermadas arcas de la Sanidad Pública (por tanto, evitar este tipo de empastes sería bueno para la salud, el medio ambiente y la economía de todos). ¿Acaso hacen falta más razones?  (Como decía Hipócrates: “Primero, no dañar”).

We Win -- FDA Must Classify Mercury Fillings           

We have won our ten-year battle to get the Food and Drug Administration to comply with the law and set a date to classify mercury amalgam.           

On Monday, we settled our lawsuit, Moms Against Mercury et al. v. Von Eschenbach, Commissioner, et al. FDA will finish classifying within one year of the close of the public comment period on its amalgam policy, that is, by July 28, 2009.           

There's more good news. During a several hour negotiation session, FDA agreed to change its website on amalgam -- dramatically. Gone, gone, gone are all of FDA's claims that no science exists that amalgam is unsafe, or that other countries have acted for environmental reasons only, or that the 2006 Scientific Panel vote affirmed amalgam's safety. Instead -- see http://www.fda.gov/cdrh/consumer/amalgams.html -- FDA has moved to a neutral course, while recognizing the serious health concerns posed by amalgam in particular for children and unborn children, for pregnant women, for those with mercury immuno-sensitivity or high mercury body burdens. FDA now states, for example:

"Dental amalgams contain mercury, which may have neurotoxic effects on the nervous systems of developing children and fetus."

"Pregnant women and persons who may have a health condition that makes them more sensitive to mercury exposure, including individuals with existing high levels of mercury bioburden, should not avoid seeking dental care, but should discuss options with their health practitioner."

Perfect?  No. A 180-degree reversal from FDA's 30-year policy of protecting mercury fillings? Absolutely.           

To change FDA policy, we tried petitions, Congressional hearings, state fact sheet laws, Scientific Advisory Committee hearings, and letters galore -- to no avail. So in the great American tradition, we sued. The case came to a head this spring. On April 22, working with Johann Wehrle and Gwen Smith, I filed a motion for an injunction before Judge Ellen Huvelle.  Three sets of briefs later, the government and I presented our oral arguments on May 16. In a crucial ruling, Judge Huvelle ruled that our 11 plaintiffs -- the diverse group listed below -- have standing. She said FDA should classify, and invited the two sides to mediate. On May 30, before Magistrate Judge John Facciola, Bob Reeves (who flew in from Lexington KY) and I hammered out an agreement with FDA officials and lawyers.           

The impact of the re-writing of its position on amalgam can hardly be understated. FDA's website will no longer be cited by the American Dental Association in public hearings. FDA shows awareness of the key issues involved. As it prepares to classify amalgam, FDA has moved to a position of neutrality. Indeed, having repeatedly raised the question of amalgam's risk to children, young women, and the immuno-sensitive persons in its website, I find it inconceivable that FDA will not in some way protect them in its upcoming rule.
